1. General Information

These Terms and Conditions govern your use of gadgetlabshop.com and purchases made through the website. The seller and website operator is Netmart LLC. Please read these Terms, the Privacy Policy, Shipping Policy and Refund Policy before placing an order.

By placing an order, you confirm that you are acting as a consumer, that the information you provide is accurate and that you have the legal capacity to enter into the purchase contract.

2. Products and Product Information

The products currently offered are presented on the relevant country-specific product pages. Product descriptions, features, contents of the package, availability and any applicable limitations are shown on those pages. Images are illustrative; minor differences in colour may result from screen settings.

We may correct genuine typographical or technical errors. If an error materially affects an order already placed, we will contact you and provide the option to confirm the corrected information or cancel the order without charge.

3. Prices

The price and currency applicable to an order are displayed on the selected market page and confirmed before the order is submitted. Prices include applicable taxes where required. Any delivery charges or other unavoidable costs payable by you will be disclosed before you place the order.

We may change future prices or availability, but a change will not alter a purchase contract already concluded.

4. Orders and Contract Formation

To order, complete the order form and submit it using the final order button. Before submitting, review the product, quantity, total price, delivery details and these Terms. After submission, we will provide an order confirmation using the contact information supplied.

We may decline or cancel an order before dispatch where the product is unavailable, the order information is incomplete or clearly incorrect, delivery is not available to the address supplied, or there is a genuine pricing or technical error. If this occurs, we will notify you. This does not limit any right you may have under applicable law.

5. Payment

Where the product page offers Cash on Delivery (COD), payment is made to the courier when the product is delivered. Any other payment method made available for a market will be shown before the order is submitted. We will never add a payment charge that was not disclosed before purchase.

6. Shipping and Delivery

We accept orders only for destinations supported by the relevant country-specific product page. Available destinations currently include Italy, Poland, Spain, Greece, Romania and Germany, subject to the delivery coverage shown during ordering.

7. Right of Withdrawal and Returns

Consumers purchasing at a distance in the European Union or European Economic Area generally have the right to withdraw from the purchase without giving a reason within 14 days from delivery, subject to applicable legal exceptions.

You do not need to provide a reason to exercise this right. Products may be inspected and handled as necessary to establish their nature, characteristics and functioning. You may be responsible only for diminished value caused by handling beyond what is necessary for that purpose. Discounted products are not excluded from statutory withdrawal rights merely because they were discounted.

8. Refunds

Refunds following a valid withdrawal will be processed without undue delay and within the period required by applicable law. We may withhold reimbursement until the returned goods are received or you provide evidence of dispatch, whichever occurs first. For Cash on Delivery orders, we may request the bank details necessary to make the reimbursement.

We do not deny a statutory refund solely because a product was sold at a discounted price or is no longer in its original packaging. Any lawful deduction for diminished value will be assessed according to the condition of the returned product and applicable consumer law.

9. Legal Guarantee of Conformity

Products sold to EU consumers are covered by the legal guarantee of conformity implemented under Directive (EU) 2019/771 and the mandatory national law applicable to the purchase. The seller is liable for a lack of conformity that exists at delivery and becomes apparent within the legally applicable period, which is at least two years for new goods under EU rules.

Where a product is defective, damaged or not as described, you may be entitled to repair or replacement free of charge or, where the applicable legal conditions are met, a price reduction or termination of the contract and refund. These statutory rights are separate from the 14-day right of withdrawal and cannot be replaced or reduced by a commercial warranty.

10. Acceptable Use and Intellectual Property

Website content, including text, graphics, branding and layout, is protected by applicable intellectual-property law. You may use the website for personal shopping and information purposes. You must not interfere with the website, attempt unauthorised access, submit fraudulent orders or reuse protected content for commercial purposes without permission.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory liability for defective or non-conforming products and liability arising from fraud, wilful misconduct, gross negligence, death or personal injury where applicable.

To the extent permitted by law, we are not responsible for losses caused solely by misuse contrary to product instructions, unauthorised alterations, or events outside our reasonable control. This section does not restrict mandatory consumer remedies.

12. Privacy

Personal data is processed as described in our Privacy Policy and in accordance with applicable data-protection law, including the GDPR where it applies.

13. Governing Law and Jurisdiction

These Terms and any contract with Netmart LLC are governed by the laws of the State of Delaware, United States, except where mandatory conflict-of-law rules provide otherwise.

If you are a consumer habitually resident in a country to which we direct our commercial activities, this choice of law does not deprive you of the protection of mandatory provisions of the law that would apply in the absence of that choice. Nothing in these Terms restricts your right to bring proceedings before any court competent under applicable consumer-jurisdiction rules, including the courts of your place of residence where such rules apply.

14. Changes to These Terms

We may update these Terms for future use of the website or future orders. The version applicable to an order is the version made available when that order is placed. Changes will not retroactively alter an existing purchase contract unless required by law or expressly agreed with you.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue to apply. The invalid provision will be interpreted or replaced only to the extent necessary under applicable law.
